Terms of Service

1. Introduction
Welcome to SwiftOrderUp. These Terms of Service ("Terms") govern your use of our service order management platform. By accessing and using SwiftOrderUp, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use our platform. SwiftOrderUp is operated by MWORKS SOFTWARE LTDA (CNPJ 40.990.926/0001-96).
2. Data Privacy
Your privacy is our highest priority. We guarantee that: • We do not sell or rent your data: The information collected through SwiftOrderUp is used to provide and improve the service. We do not sell or rent your data. To operate the platform, we rely on service providers that process data on our behalf — cloud hosting and storage, email delivery, and subscription management — and, when a purchase happens inside the app, the store processes the payment. Each of them receives only what is necessary for its role, and the full list is in our Privacy Policy. • Data is stored securely: All traffic between the app and our servers is protected by HTTPS, passwords are stored only as a cryptographic hash, and production credentials are kept in a secrets manager, outside the source code. Each company has its own isolated database, which prevents one company from reaching another company's data. No system is immune to incidents: in the event of a breach with relevant risk, we will notify you and the competent authority.
3. Optional Data and User Privacy
SwiftOrderUp is designed with privacy first in mind: • Minimal identification: Much of the data entered into the platform is optional. To create and use an account we ask only for a name and an e-mail address; phone number, document number and address are optional. We do not ask for your home address — the addresses you register are the service locations. • Data minimization: We collect only the information necessary for the effective operation of the service. • User control: You have full control over what information you choose to provide and can manage your privacy preferences at any time.
4. User Content
You retain full ownership of all content you create and store on SwiftOrderUp. By using our platform, you grant us a license to store, process, and manage your content specifically to provide the services you request.
5. Acceptable Use
You agree to use SwiftOrderUp only for lawful and legitimate purposes. You must not: • Violate any applicable law or regulation • Use the platform for illegal or fraudulent purposes • Attempt to access other users' data without authorization • Interfere with the proper functioning of the platform • Submit malicious content, viruses, or harmful code • Collect or track personal information from others without consent
6. Intellectual Property
All rights, titles, and interests in SwiftOrderUp, including features, design, and original content, are the exclusive property of SwiftOrderUp. You may not reproduce, modify, distribute, or transmit any part of the platform without our prior written consent.
7. Service Availability
While we strive to keep the platform available 24/7, we do not guarantee that SwiftOrderUp will operate without interruptions. We reserve the right to: • Perform necessary maintenance and updates • Modify or discontinue platform features • Limit access in cases of abuse or violation of terms • Discontinue service for security or compliance reasons
8. Development Stage and Bug Reports
SwiftOrderUp is at an early development stage and evolves continuously. Failures, unexpected behaviour and feature changes may occur, and the platform is provided as is. • Reporting a failure: We encourage you to report any failure you find through our support channels. The sooner we know, the sooner we fix it. • Acknowledging a report: When we identify and confirm a failure you reported, we may, at our sole discretion, grant an extension to the validity period of the plan you have subscribed at that time. This is a case-by-case goodwill gesture: it depends on our identification and agreement, it creates no vested right, and it does not oblige us to grant the same in similar situations. • No conversion into money: A period extension is the only form of acknowledgement we offer for a failure report. It is not converted into a refund, credit, discount, payment or any other financial compensation, and it can be neither transferred nor exchanged. • What this section does not affect: Nothing here restricts the rights the law grants you, nor the refund policies of the app store or payment processor through which the subscription was purchased, covered in the Plans, Subscriptions, and Pricing section.
9. Plans, Subscriptions, and Pricing
SwiftOrderUp offers a free plan (with usage limits) and paid subscription plans: • Billing and renewal: Subscriptions renew automatically at the end of each cycle (monthly or annual) at the then-current price, until you cancel. Payment is processed by third-party platforms (app stores and/or a payment processor), whose terms also apply to the transaction. • Prices subject to change: Prices may change at any time according to market conditions, operating costs, taxes, and currency fluctuations. A price change does not affect the cycle you already paid for — it takes effect on the next renewal, and we will give reasonable advance notice where required by law. • Currency and taxes: Prices may be displayed and charged in different currencies depending on your region, and applicable taxes may be added in accordance with local law. • Cancellation and refunds: You may cancel at any time; paid access remains until the end of the period already paid for, with no prorated refund except where required by law. Refunds, where applicable, follow the policy of the payment platform used.
10. Limitation of Liability
To the maximum extent permitted by law, SwiftOrderUp shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from the use or inability to use the platform, even if advised of the possibility of such damages.
11. Modifications to Terms
We reserve the right to modify these Terms at any time. Modifications will be effective as soon as they are posted. Your continued use of the platform following such modifications constitutes your acceptance of the new Terms. We recommend that you regularly review these Terms to stay informed of any changes.
12. Termination
We may terminate or suspend your account immediately, without notice, if you violate any provision of these Terms or if we determine that your use poses a security or compliance risk. You may terminate your account at any time through your account settings.
